Under International Humanitarian Law , it is legally fundamental to obtain consent of all belligerent state and its adversaries , even sometimes in pure non- international armed conflicts that witnesses fighting among non-state armored groups the consent of those groups is prerequisite .

It is necessary to obtain permission from the country in whose territory the humanitarian relief will be distributed, that is, from the official authority over whose territory the conflict is taking place, even if these areas are under the control of the rebel forces like the current case in Syria at the distressed areas that were hit by the devastating earthquake .
It is difficult for humanitarian aid to reach the territories and enclaves in Syria that are still out of control of the Syrian authorities .
Therefore, it would be illogic and illegal to ignore and disregard the consent of the concerned state and regarding only the consent of its adversaries . If this happens this will be considered recognition of them .
The striking and comparable example in this connection is the current non-international armed conflict in Somalia where humanitarian relief was the main source for providing supplies to warlords , and this helped to prolong the already protracted war in Somalia
